Terms of Service

1. Acceptance of Terms

By accessing or using Broadcastr ("the Service"), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree to these terms, you are prohibited from using the Service. These terms apply to all users including visitors, registered users, and paying subscribers.

2. Description of Service

Broadcastr is a social media management, content scheduling, AI content generation, SEO, advertising, and email marketing platform. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. Email marketing features are subject to monthly sending limits based on your plan (Free: 500/mo, Starter: 5,000/mo, Pro: 25,000/mo, Agency: 100,000/mo). Limits reset on the 1st of each month and unused quota does not roll over.

3. Third-Party Platform Integrations

Broadcastr integrates with the following third-party platforms to enable content publishing and management: Twitter/X (X Corp), Instagram (Meta), Facebook (Meta), LinkedIn (LinkedIn Corporation), TikTok (ByteDance), YouTube (Google LLC), Pinterest, Bluesky (Bluesky PBLLC), Mastodon, Google Business Profile (Google LLC), Yelp, and other platforms as added. Your use of these integrations is also governed by each platform's own Terms of Service and Community Guidelines. You are solely responsible for ensuring your content complies with each platform's rules. Broadcastr does not guarantee uninterrupted access to third-party platform APIs and is not liable for actions taken by third-party platforms including account suspension, API revocation, or content removal. API access is provided by: Meta Platform Terms, Twitter Developer Agreement, Google API Terms of Service, LinkedIn API Terms, TikTok Developer Terms, and others as applicable.

4. Account Registration

You must be at least 18 years old to create an account. You must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must immediately notify us of any unauthorized use of your account at support1@broadcastr.online.

5. Subscription and Billing

Paid plans are billed monthly or annually as selected. Subscriptions automatically renew unless cancelled before the renewal date. We offer a 7-day free trial on paid plans — your card will not be charged until the trial ends. You may cancel anytime from your billing dashboard. Refunds are handled on a case-by-case basis. Contact support1@broadcastr.online for refund requests. Payments are processed by Stripe, Inc. and are subject to Stripe's Terms of Service.

6. Acceptable Use

You agree not to use Broadcastr to: send spam or unsolicited bulk messages; distribute malware, viruses, or harmful code; violate any applicable local, state, national, or international law; infringe intellectual property rights of any party; harass, abuse, or harm any person; scrape, crawl, or data-mine the Service without permission; attempt to gain unauthorized access to any part of the Service or its infrastructure; use the Service to post content that is illegal, defamatory, obscene, or violates any platform's community guidelines; or engage in any activity that disrupts or degrades the Service.

7. Content Ownership and License

You retain full ownership of all content you create, upload, or publish through Broadcastr. By using the Service, you grant Broadcastr a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely for the purpose of providing the Service. We do not claim ownership of your content and will not use it for advertising or any purpose beyond operating the Service.

8. AI-Generated Content

Broadcastr uses AI tools (including Groq and large language models) to assist with content generation. AI-generated content is provided as a starting point and may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing, editing, and approving any AI-generated content before publishing. Broadcastr makes no warranties regarding the accuracy or fitness of AI-generated content.

9. Intellectual Property

All technology, trademarks, trade names, logos, and proprietary content associated with Broadcastr are owned by or licensed to Broadcastr. You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying technology without prior written permission.

10. Privacy

Your use of Broadcastr is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, Broadcastr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Broadcastr and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may cancel your account at any time from your billing dashboard. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the courts of Delaware.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
